The Offer only applies to online purchases at sienasleep.com for purchases for delivery in the United States. The Offer will be auto-applied to your order. The Offer cannot be combined with any other offers or promotions. The Offer cannot be applied to past orders, shipping costs, or taxes, and is not valid in-store. Limit of one (1) Offer per customer. Return policy applies only to mattress purchases. Any pricing or availability referenced in advertising represents certain product sizing and availability only and is not representative of pricing or availability for every product. Siena "2-5 Day Shipping" Promise Terms
Effective Date: October 15, 2022
Siena’s shipping time promise applies to most products sold at sienasleep.com except where otherwise indicated in the check out purchase process that inventory may be limited or longer ship times applicable. Where Siena is unable to meet the shipping dates provided at the date of purchase, the customer will be promptly notified via email of any such changed shipping times. Shipping time does not include order processing time. This shipping promise does not apply to inventory that is marked out of stock on order.
Siena's Shopper Experience Survey 2023 Giveaway Official Rules
Sponsored by Resident Home, LLC (d.b.a. “Siena Sleep”)
NO ENTRY FEE. NO PURCHASE OR OBLIGATION NECESSARY TO ENTER OR WIN. Giveaway begins on August 11, 2023 at 12:00:00AM EST and ends on September 11, 2023 at 11:59:59PM EST (the “Promotion Period”).
I. Eligibility: The Siena Sleep (“Siena”) Shopper Experience Survey 2023 Giveaway (the “Giveaway”) is open to legal U.S. residents, eighteen (18) or older. Employees of Siena and its parent company, subsidiaries, individuals providing services to Siena through an outsourcer or temporary employment agency during the Giveaway period, and their respective immediate family members and persons living in their same household, are not eligible to participate in the Giveaway. Participation in the Giveaway constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules & Regulations (“Official Rules”). VOID WHERE PROHIBITED.
II. Agreement to Rules: BY PARTICIPATING IN THIS GIVEAWAY, YOU AGREE TO BE FULLY UNCONDITIONALLY BOUND BY THESE RULES, AND YOU REPRESENT AND WARRANT THAT YOU MEET THE ELIGIBILITY REQUIREMENTS SET FORTH IN SECTION 1 OF THESE RULES. IN ADDITION, YOU AGREE TO ACCEPT THE DECISIONS OF SIENA AS FINAL AND BINDING AS IT RELATES TO THE CONTENT. THE GIVEAWAY IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS.
III. How To Enter: During the Promotion Period, you can enter the Giveaway by completing and submitting the Siena Shopper Experience Survey.
IV. Entry Limit: Limit one (1) Entry per e-mail account during the Promotion Period. You may not create multiple accounts using multiple identities to gain more than the entry.
Use of any automated system to participate is prohibited and will result in disqualification. We are not responsible for Entries that we do not receive for any reason, or for Entries that we receive but are not decipherable for any reason. We will automatically disqualify: any incomplete or illegible Entry; and any Entries that we receive from you that are in excess of the entry limit and do not satisfy the requirements described above.
V. Prize Drawing: All valid Giveaway Entries meeting the requirements of these Official Rules will receive the prize described below.
VI. Prize and Odds: The prize to be awarded from the Giveaway are as follows:
A) One (1) Visa Gift Card, valued at Ten Dollars ($10.00)(USD).
The prize recipients will receive their prize via email. Prize recipients will be contacted by the Siena team upon submission of a completed Siena Shopper Experience Survey via the email account provided in the survey. Once prize recipients receive their prize, Siena is not responsible for, and will not replace, the prize in the event of loss, theft or any other damage.
The odds of receiving the prize is 100% for all Entrants that complete and submit the Siena Shopper Experience Survey. No cash or other substitution of the prize is permitted, except at the sole option of Siena for a prize of equal or greater value. Prize recipients are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to the prize.
VII. Notification of Prize Recipients: Prize recipients will be notified by direct message via e-mail immediately following the submission of a complete Siena Shopper Experience Survey. To collect the prize, the prize recipient may be required to sign and return an affidavit of eligibility and publicity/liability release. In the event of a dispute regarding who submitted an Entry, the Entry will be deemed submitted by the authorized account holder of the email account used in the Siena Shopper Experience Survey. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
VIII. General Rules: By entering the Giveaway, you agree to be bound by these Official Rules. The Giveaway is offered by Siena, which is not responsible for (i) late, lost, delayed, damaged, postage-due, incomplete, illegible, misdirected or undeliverable Entries, responses, or other correspondence, whether by e-mail or postal mail or otherwise; (ii) unauthorized access to or alterations of Entries; or (iii) phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties.
By entering the Giveaway, you further agree to release, indemnify, defend and hold Siena and its parent, affiliates, subsidiaries, directors, officers, employees, sponsors and agents, including advertising and promotion agencies, and assigns, and any other organizations related to the Giveaway, harmless, from any and all claims, injuries, damages, expenses or losses to person or property and/or liabilities of any nature that in any way arise from participation in this Giveaway or acceptance or use of the prize or parts thereof, including, without limitation, (i) any condition caused by events beyond Siena’s control that may cause the Giveaway to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Giveaway; and (iii) any printing or typographical errors in any materials associated with the Giveaway.
IN NO EVENT WILL SIENA BE LIABLE TO YOU FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE GIVEAWAY, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SIENA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
IX. Additional Conditions: Except where prohibited, by participating in the Giveaway and/or receiving a prize, entrants consent to the use of his/her name, photo and/or likeness, biographical information, entry and statements attributed to entrants (if true) for advertising and promotional purposes, including without limitation, inclusion in Siena’s newsletters and Siena’s homepage at www.sienasleep.com, without additional compensation.
Siena reserves the right, in its sole discretion, to cancel, modify or suspend the Giveaway in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Giveaway is compromised, without liability to the entrant. Siena reserves the right to disqualify any entrant, as determined by Siena, in its sole discretion. The decisions of Siena are final and binding on all matters pertaining to the Giveaway.
X. Governing Law and Choice of Forum: These Official Rules are governed by the law of the State of California, excluding rules governing choice of laws. Any action, suit or case arising out of, or in connection with, this Giveaway or these Official Rules must be brought in either the federal courts located in the Northern district of California or the state courts located in Santa Clara County, California.
XI. Personal Information: Siena may collect personal data about entrants online, in accordance with its Privacy Policy and as may be more specifically set forth in these Official Rules. Please review these Official Rules and Siena’s Privacy Policy at www.sienasleep.com/p/privacypolicy/. By participating in the Giveaway, entrants hereby agree to Siena’s collection and use of their personal information and acknowledge that they have read and accepted these Official Rules and Siena’s Privacy Policy.
